Types of Witnesses

There are different types of witnesses who give evidence at court.  There are complainant and non-complainant witnesses. A complainant witness is the victim of the crime. A non-complainant witness is someone who has witnessed, heard or knows something that the Court needs to hear about.

The victim maybe someone in your family or a friend or someone you do not know.

It is important to know which type of witness you - or the person using this site is, as this could affect when and how you give evidence. Ask your child witness officer or the police officer if you are not sure. 

If you are complainant in a case involving a sexual assault or family violence the court you will give evidence from a remote witness room and the Court will be closed while you give you evidence. The only people in court will be the Judge or Magistrate, the court staff, legal team and the person charged with the offences – if you are giving your evidence from a remote witness room you will not see the person/ s charged with the offences
